Dead By Daylight Roblox clone Forsaken is at the center of a new lawsuit, filed in late April, as developers fight over who owns the game. Originally published by Peter Innes, known in the Roblox community as Soul, Forsaken is a popular Roblox game that's amassed nearly 5 billion visits and has more than 44,000 active players at the time of writing, making it one of the top 25 games on Roblox right now. But when Innes was accused of "personal misconduct" in 2025, the developer looked to pass along ownership to someone else. Eventually, a contract was drawn up and two Roblox developers, Eli Adams, also known as Hytoko, and Reyna Balboa, also known as Basil, took over. Now, Adams and Balboa say Innes is trying to undo the contract after Innes' parents found out about the deal. (All parties are over 18, according to court documents filed in late April.)
After allegations around Innes' behavior surfaced, and which caused community uproar online, Innes first sold the game to a different developer. The accusations are documented through Google Docs and recounted through YouTube videos and on forums and range from allegations of stalking, stealing money, and grooming children. Aftermath is unable to verify them.
That contract was dissolved within months before Innes again started to speak to Adams and Balboa (who worked on Forsaken already) about permanent transfer of the game, according to the complaint. Adams drafted a transfer agreement, and after some back and forth regarding a termination clause, it was signed. The details of the contract are redacted in the complaint, but lawyers for Adams and Balboa say the contract was written in such a way that Innes' parents would not know about the sale. The contract gave Innes $350,000, a 40% revenue share, and control of one of the game's financial accounts. Per lawyers, this was part of the ruse to conceal the fact he sold the game
Adams and Balboa took over, which their lawyers say was "no small task," because "many developers" were owed revenue share for Forsaken. Roblox developers, many who are children or young adults, often work on games in exchange for "shares"—often informal agreements that aren't always legally binding.
Adams and Balboa's lawyers say Innes was "ecstatic" to see Forsaken reach a peak of one million players weeks after the sale. Innes' parents, however, started to seek out lawyers to get the IP back, Innes told the new owners. Redactions in the complaint make the next piece confusing; lawyer Adam Starr, in a thread on X, says that this portion appears to deal with payments from the contract that were sent to a Roblox account that Innes no longer had access to. Innes eventually got access to the account back, but told Roblox to freeze the account "pending the threatened litigation," Adams and Balboa's lawyers say in the complaint. They also allege Innes shared confidential details of the contract and leaked information using a burner X account.
In March, Innes "formally asserted" that the transfer agreement was "void and unenforceable." The April lawsuit, from Adams and Balboa, was filed in late April, after the notice. Adams, posting to X, said on May 11 that Innes "has attempted to regain control of the game" with "potential plans to remove numerous members of the team."
"We are not and have no intention of letting this game return to their hands. Due to their persistence on this, Basil and I have hired a litigator and filed a request to the courts confirming Soul does not have the rights to the IP anymore," Adams wrote on X.
Adams and Balboa are asking the court to declare that the contract is indeed valid and enforceable, ensuring their continued ownership of Forsaken. They also allege a breach of contract and say they've "suffered damages" as a result "in an amount not less than $100,000 (representing at least two breaches at $50,000 each), plus any additional $50,000-per-breach amounts established through discovery, plus injunctive relief enjoining further disclosures."
Aftermath reached out to a lawyer for Adams and Balboa, but was unable to reach Innes for comment.
